POWER OF ATTORNEY/AFFIDAVIT RELATING TO PROPERTY OR FINANCIAL MATTERS

 Applicant signing Power of Attorney (POA) must ensure that his/her signature on the POA matches with that in the current valid passport.

The Consulate does not prescribe any specific format for POA and it could be as per applicant’s requirements either in a plain paper or in Indian Stamp Paper (The Consulate doesn’t provide Stamp Papers). POA should be notarized by a public Notary before sending it to the consulate.


Applicant is also required to affix one current photograph on the last page of the POA and submit a photocopy of the POA for retention by the Consulate.

In case of Indian origin applicants holding non-Indian passports, they should first get the POA apostilled before submitting the application at the Consulate.  The appostile of PoA is not required, if the applicant holds a valid OCI/PIO card or a valid Indian VISA.The appostile of document is done at the Office of the Secretary of State of the state concerned. 

POA of a person who is mentally incapacitated will not be accepted. Such cases will be entertained only if the applicant has notarized judicial orders of guardianship of the person who is the main executor of the POA.

The pages of the PoA where applicants wants attestation by the consulate should be Notarized by a public Notary.

Applicants resident in Alabama, Florida, Georgia, Mississippi, Puerto Rico, South Carolina,  Tennessee and US Virgin Islands can apply. 

How to Apply by Mail:


 

 Download the Miscellaneous application Form bullet, print & sign it paste the photograph and Post it to the Consulate along with the other supporting documents. If application is being sent by post please sent a separate $20/- cashier’s check or money order fee for return mail. Or Enclose a trackable pre-paid self-addressed return mailing envelope.

Please attach the Clear Notarised photocopy of the  Passport, Address Proof, Legal Status. 

 List of documents valid as a proof of Address/Residence (Copy of any one of following):

  • • US Driving License OR
  • • Utility Bill OR
  • • Lease Agreement OR
  • • State Identity Card OR
  • • Mortgage Deed

 Proof of US Visa Status (Copy of any one of the following):

  • • Visa page of Passport (i.e. H1B, H4, L1, L2 etc.) OR
  • • Green Card OR
  • • Employment Authorization Document (Work Permit) OR

I-797, I-140 or I-20 (If approval is pending, attach a handwritten note detailing the efforts being taken to regularize status)

  • • Applicants who are on B1/B2 Visa should provide I-94 with the application. Their stay should not exceed more than 180  days in the country. In case they are exceeding their stay in the country they will have to provide the approval Notice or If approval is pending, attach a handwritten note detailing the efforts being taken to regularize status.

 

Fee:  A fee of US$ 20.00 (Twenty Only) per Page in favor of Consulate General of India, Atlanta(CGI,Atlanta) and an additional fee with a separate cheque or money order of US$ 2.00 (Two Only) per application towards Indian Community Welfare Fund (ICWF).  The fees may be paid only by money orders/cashier’s cheques. For joint POA, each applicant should submit a separate Misc application Form and pay the applicable fees Which is $20 per applicant  per page. And $2 in favor of ICWF.

 

(Personal Cheques, Credit Cards, Debit Cards Or Other Banking Instruments Are Not Accepted)

 

Processing time: 5-7 working days from the date of receipt of applications by post. This is subject to submission of all requisite documents by the applicant(s).

Incomplete applications will be sent back without the service indicating the requisites to complete.
